Non-Payment of Parking Fines
« BackWhere a parking infringement notice is issued to a person, either hand delivered or mailed and the person takes no action within 28 days, the infringement notice is registered as a debt with the State Penalties Enforcement Registry (SPER) for recovery and further costs will be incurred. The further costs include, but are not limited to the SPER debt registration fee.
Where a regulated parking infringement is attached to a vehicle, if no action is taken within the 28 day period, a Citec Vehicle Registration search is undertaken to obtain the vehicle owners name and address and a reminder notice is issued to the registered owner of the vehicle.
A reminder notice is issued for a number of reasons including when the vehicle has been used by another person and the owner is unaware of the infringement, or the vehicle had been sold but the vehicle registration details have not been changed.
When a reminder notice is issued to the owner of the vehicle, Council allows 14 days to make full payment. The cost of the Citec search fee is recoverable from the vehicle owner and is added to the original infringement notice amount.
If no payment is received by the due date then Council will forward the matter to SPER for recovery and further costs will be incurred.
SPER can take enforcement action against the recipient in the form of:
- Driver's licence suspension
- Fines collection notice
- Immobilisation warrant
- Seizure of property
- Arrest warrant
